They Towed My Car!

Towing of vehicles is a serious point of contention in Nevada HOAs. There have been some recent changes in the state law that give vehicle owners some protection against unfair towing practices. One important improvement in state law requires the association to attach a warning notice on the vehicle 48 hours prior to towing. I recently got an email from a vehicle owner whose car was towed without any warning and his cost to get it back was $185. Most likely the association will have to pay for that expense if he should decide to press it.

Another weird thing about his situation is that he was told that the towing rules were in the association governing documents but when he asked for a copy he was refused on the grounds that he was not an owner. He had moved into the house on a lease with purchase option and apparently one of the board members did not like the idea that he was not an owner. He believes that towing was simply a form of harrassment to try to force him out. The person who is doing the harassing may found himself on the wrong end of a lawsuit over this matter.
